Settle Your Agreement

We only represent staff, so we really understand what your concerns are when you have been mistreated at work and how you can help you get a fair settlement. If your employer wants you to give up your right to go to court, there are only two ways to do it legally: everything is based on your salary, because the more you earn, the higher your demand. If you have argued with your employer, it is a good idea to require that the transaction contract be accompanied by a reference agreed with a clause that the employer cannot deviate from this agreed reference. Transaction agreements are a very useful way to ensure that disputes between employers and workers (or potential disputes) are concluded without both parties being forced to take legal action. However, the law can be complex with regard to them and it is always a good idea to take appropriate professional advice before starting to go along the route of the settlement agreement. If you are approaching retirement age, then any right could be of a much higher value, because it might be more difficult for you to get another job, so your financial loss could be greater. Other terms that can be negotiated are confidentiality clauses; clauses that expect you to “not denigrate badly” your employer (you can ask them the same thing); Holidays in the garden and maintaining ownership of the business such as a car or phone. Then it must be verified and signed by your lawyer, who will also provide you with independent legal advice on whether the agreement is in your best interest. The terms of the transaction agreement are agreed between the employer and the worker.

These conditions are then defined in the written transaction document, which defines the claims that the worker does not wish to claim in exchange for the agreed payment. Sick leave can help increase the amount you should receive in your comparison contract, especially if you have a lot of paid absenteeism. It is also very important that all discussions between the parties on the proposed agreement comply with certain legal requirements, otherwise, if the agreement is not concluded at the end, these discussions could be used as evidence in all subsequent court proceedings. If you have recently filed a complaint, then your employer will often want to pay you instead of spending time and money investigating your complaint. Remember, however, if you can bypass this process by filing a non-prejudiced letter first.
